A work visa is required if you want to work in Canada. The Canada work visa is often referred to as the Canada work permit. If you are not a permanent resident but are offered a job by a Canadian company, you must apply for a work visa.

The two forms of work permits available in Canada are the open-work permit and the employer-specific work permit.

The open work visa is not tied to any specific job or company. Employer-specific job permits, on the other hand, allow foreign workers to work for a certain employer in a specified position. These permit holders must apply for a new work permit if they want to change jobs or take on extra obligations within the same job.

While an employer-specific work permit is restricted to a single employer, an open work permit may be subject to the permit’s criteria. Among these are:
  • Work Type
  • Workplaces
  • Work time

Holders of the following visas are eligible to apply for an Open Work Permit:
  • Temporary Work Permits for spouses
  • Post-Graduation Work Permit
  • Temporary Resident Permit
  • World Youth Program Permit
  • Atlantic Immigration Pilot Program Spousal Permit
  • Regular Open Work Permit
  • Bridging Open Work Permit

Those who want to work in Canada choose the open work permit due to the flexibility it provides in terms of moving between firms, changing jobs in Canada, or shifting to various parts of the country.

It benefits Canadian firms because an open work visa does not necessitate a Labor Market Impact Assessment (LMIA) when hiring a foreign employee.

Qualification for an open work permit

There are numerous ways to be qualified for an open work visa; these are some of the most common:

Students from other countries:

International students who have completed a two-year full-time study program may be permitted to work in Canada for up to three years following graduation. Study programs that last more than eight months but less than two years may be eligible for a PGWP that corresponds to their length.

To be eligible, international students must attend a Designated Learning Institution (DLI) in Canada. As a result of the epidemic, the IRCC has made several changes to the eligibility requirements. For example, between March 2020 and August 2022, IRCC will allow international students to complete their academic degree entirely online.

Citizens of other nations with reciprocal treaties:

The International Experience Canada (IEC) program allows international students from over 30 countries to work in Canada.

Young persons aged 18 to 35 may be eligible for a Working Holiday visa. Participants are not need to have a job offer in order to participate in the IEC, but they must meet the qualifying conditions.

Candidates must have $2,500 CAD in cash to cover expenses, be unaccompanied by dependents, and be eligible to enter Canada, among other conditions.

Canadians or temporary residents who are married to or living with a common-law partner:

Canadian spouses, temporary foreign workers, and international students can apply for open work permit options in Canada.

Spouses of Canadian citizens and permanent residents may be eligible for a Spousal Open Work Permit if they apply under inland sponsorship and live in Canada with their partner.

Spouses of temporary foreign employees may also be eligible for an open work permit. The temporary foreign worker must meet specified eligibility conditions, such as having a valid work visa for at least six months after acquiring the open spousal work permit.

The four conditions that the foreign worker must meet are: working in a National Occupational Classification (NOC) skill level of 0, A, or B; working in any occupation when accepted into an Atlantic Immigration Program (AIP) stream; working in any occupation with a provincial or territorial nomination from the Provincial Nominee Program (PNP); or working in any occupation and holding a Quebec Selection Certificate (CSQ). Other program-specific criteria must also be met, depending on the status of the temporary foreign worker.

Finally, spouses of international students may be able to receive an open work visa if they can demonstrate to the authorities that they are in a real relationship and that the overseas student is enrolled in an appropriate program.

Those seeking a permanent residency permit:

Bridging Open Work Permits (BOWPs) allow individuals who have applied for permanent residency in Canada to remain in the country while their application is being reviewed.

The following immigration programs are eligible for a BOWP:
  • Federal Skilled Worker Program
  • Canadian Experience Class
  • Federal Skilled Trades Program
  • Provincial Nominee Program
  • Quebec Skilled Workers
  • Agri-Food Pilot Program

The BOWP ensures that foreign nationals do not have to abandon their jobs or the country if their temporary status expires before their permanent residency application is finalized. It also means that employers are no longer obliged to seek an LMIA-based work permit in order to retain their international employees.

When compared to other work permits issued by Canada, the Canada open work permit is a suitable alternative for those looking for a job in Canada because of its flexibility features and simplified eligibility standards.
